2. Eligibility

You represent and warrant that:

• You are at least 18 years old, or if you are under 18 years old, you have the permission and involvement of a parent or legal guardian who agrees to these Terms on your behalf
• You have the legal capacity to enter into a binding agreement
• If representing an organization, you have the authority to bind that entity

For users under 18 years of age, a parent or legal guardian must consent to these Terms on behalf of the minor user and supervise their use of our Services. Parents or legal guardians are responsible for the minor's actions and compliance with all Terms herein. By allowing a minor to use our Services, the parent or legal guardian acknowledges and agrees to be bound by these Terms and to assume full responsibility for the minor's use of the Services.

3. Platform Account Registration

When creating an account, you agree to provide accurate, current, and complete information and to update your data as necessary. You are responsible for safeguarding your account credentials and any activities or usage under your account. 4. Use of the Platforms

a. Permitted Uses

You agree to use our Services only for lawful purposes and in a manner that does not infringe on the rights of, or restrict or inhibit the use and enjoyment by, any other user of the Platforms.

b. Prohibited Conduct

You agree not to:

• Engage in any activity that could harm, disable, or overburden our Platforms.
• Attempt to gain unauthorized access to any part of the Platforms, including other users' accounts or data.
• Use automated scripts, bots, or other means to access or monitor the Platforms without our express prior written consent.
• Reverse engineer, decompile, or otherwise attempt to extract the source code of our mobile applications unless explicitly permitted by applicable law.

c. Service Restrictions and Regulatory Compliance

The Services are not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. Persons who choose to access the Services from locations outside our intended service area do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.

Our Services are not designed or tailored to comply with industry-specific regulations such as:

• Health Insurance Portability and Accountability Act (HIPAA)
• Federal Information Security Management Act (FISMA)
• Gramm-Leach-Bliley Act (GLBA)

If your interactions would be subject to such laws, you may not use our Services. Additionally, you are prohibited from using the Services in any way that would violate these or similar regulatory requirements.

5. Intellectual Property Rights

a. Our Intellectual Property

We are the owner or the licensee of all intellectual property rights in our Services, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics in the Services (collectively, the "Content"), as well as the trademarks, service marks, and logos contained therein (the "Marks").

Our Content and Marks are protected by copyright and trademark laws (and various other intellectual property rights and unfair competition laws) and treaties in the United States and around the world. The Content and Marks are provided in or through the Services "AS IS" for your personal, non-commercial use only.

b. License to Use Our Services

Subject to your compliance with these Terms, including the "Prohibited Conduct" section above, we grant you a non-exclusive, non-transferable, revocable license to:

• Access the Services
• Download or print a copy of any portion of the Content to which you have properly gained access

This license is solely for your personal, non-commercial use. Except as set out in this section or elsewhere in our Terms, no part of the Services and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

If we ever grant you permission to post, reproduce, or publicly display any part of our Services or Content, you must identify us as the owners or licensors of the Services, Content, or Marks and ensure that any copyright or proprietary notice appears or is visible on posting, reproducing, or displaying our Content.

We reserve all rights not expressly granted to you in and to the Services, Content, and Marks. Any breach of these Intellectual Property Rights will constitute a material breach of our Terms and your right to use our Services will terminate immediately.

c. Your Submissions

By directly sending us any question, comment, suggestion, idea, feedback, or other information about the Services ("Submissions"), you agree to assign to us all intellectual property rights in such Submission. You agree that we shall own this Submission and be entitled to its unrestricted use and dissemination for any lawful purpose, commercial or otherwise, without acknowledgment or compensation to you.

You are responsible for what you post or upload. By sending us Submissions through any part of the Services you:

• Confirm that you have read and agree with our "Prohibited Conduct" section and will not post, send, publish, upload, or transmit through the Services any Submission that is illegal, harassing, hateful, harmful, defamatory, obscene, bullying, abusive, discriminatory, threatening to any person or group, sexually explicit, false, inaccurate, deceitful, or misleading
• To the extent permissible by applicable law, waive any and all moral rights to any such Submission
• Warrant that any such Submissions are original to you or that you have the necessary rights and licenses to submit such Submissions and that you have full authority to grant us the above-mentioned rights in relation to your Submissions
• Warrant and represent that your Submissions do not constitute confidential information

You are solely responsible for your Submissions and you expressly agree to reimburse us for any and all losses that we may suffer because of your breach of (a) this section, (b) any third party's intellectual property rights, or (c) applicable law.

6. Digital Content Usage Policy

a. Personal Use Only

Content is licensed exclusively to the individual account holder. Each user account is personal and non-transferable, and the associated content access rights are strictly limited to the registered account holder.

b. No Unauthorized Distribution

Copying, reproducing, or distributing content is strictly prohibited. Users may not share, transfer, sublicense, or redistribute any content accessed through our Services to any third party, whether for commercial purposes or otherwise.

c. Account Security

You are responsible for maintaining account confidentiality. This includes protecting your login credentials, preventing unauthorized access to your account, and ensuring that content accessed through your account is not shared with or accessed by others.

7. User Contributions

Any content you submit (suggestions, feedback, etc.) becomes non-confidential and we are free to use such content as we deem appropriate. By submitting content, you grant us a worldwide, royalty-free, perpetual, and irrevocable license to use, reproduce, modify, distribute, and display such contributions.

We shall own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use and dissemination of these Submissions for any lawful purpose, commercial or otherwise, without acknowledgment or compensation to you. You hereby waive all moral rights to any such Submissions, and you hereby warrant that any such Submissions are original with you or that you have the right to submit such Submissions. You agree there shall be no recourse against us for any alleged or actual infringement or misappropriation of any proprietary right in your submissions.

8. Third-Party Websites and Content

The Services may contain (or you may be sent via the Site) links to other websites ("Third-Party Websites") as well as articles, photographs, text, graphics, pictures, designs, music, sound, video, information, applications, software, and other content or items belonging to or originating from third parties ("Third-Party Content").

a. No Monitoring or Verification

Such Third-Party Websites and Third-Party Content are not investigated, monitored, or checked for accuracy, appropriateness, or completeness by us. We are not responsible for any Third-Party Websites accessed through the Services or any Third-Party Content posted on, available through, or installed from the Services, including the content, accuracy, offensiveness, opinions, reliability, privacy practices, or other policies contained in the Third-Party Websites or the Third-Party Content.

b. No Endorsement

Inclusion of, linking to, or permitting the use or installation of any Third-Party Websites or any Third-Party Content does not imply approval or endorsement thereof by us. If you decide to leave the Services and access the Third-Party Websites or to use or install any Third-Party Content, you do so at your own risk, and you should be aware these Terms no longer govern.

c. Third-Party Terms and Policies

You should review the applicable terms and policies, including privacy and data gathering practices, of any website to which you navigate from the Services or relating to any applications you use or install from the Services.

d. Third-Party Purchases

Any purchases you make through Third-Party Websites will be through other websites and from other companies, and we take no responsibility whatsoever in relation to such purchases which are exclusively between you and the applicable third party.

e. Disclaimer of Liability

You agree and acknowledge that we do not endorse the products or services offered on Third-Party Websites and you shall hold us blameless from any harm caused by your purchase of such products or services. Additionally, you shall hold us blameless from any losses sustained by you or harm caused to you relating to or resulting in any way from any Third-Party Content or any contact with Third-Party Websites.

9. Mobile Application Specific Terms

a. App Store Policies

Your use of our mobile applications is also subject to the terms and conditions of the app marketplaces (e.g., Apple App Store, Google Play Store) from which you downloaded the application. In the event of any conflict between these Terms and the app store terms, these Terms shall govern your use of the Services directly provided by Best SAT Score.

b. Updates and Push Notifications

We may update or modify our mobile applications from time to time. These updates are subject to the same Terms. With your consent, we may send you push notifications and alerts regarding app updates, promotional offers, or other relevant information.

10. Payment and Subscription Terms

If you purchase any subscriptions, or other paid services:

• You agree to pay all applicable fees.
• We may modify pricing, provided that such modifications will not affect fees for services purchased prior to a change.
• Payment obligations are non-cancellable and non-refundable, except as provided in our refund policy or as required by law.

11. Data Security, Privacy, and User Data

a. Privacy Policy

b. Data Management and Backups

We will maintain certain data that you transmit to the Services for the purpose of managing the performance of the Services, as well as data relating to your use of the Services. Although we perform regular routine backups of data, you are solely responsible for all data that you transmit or that relates to any activity you have undertaken using the Services.

c. Limitation of Liability for Data Loss

You agree that we shall have no liability to you for any loss or corruption of any such data, and you hereby waive any right of action against us arising from any such loss or corruption of such data.

d. User Responsibilities

It is recommended that you maintain backup copies of any important data, files, or information you upload or access through the Services on your own separate storage device or platform. While we strive to protect your data, we cannot guarantee the absolute security or integrity of data transmitted through our Services.

12. Disclaimers and Limitation of Liability

a. No Warranty

Our Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. To the fullest extent permitted by law, Best SAT Score disclaims all warranties, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

b. Limitation of Liability

In no event shall Best SAT Score be liable for any indirect, incidental, consequential, or punitive damages, including lost profits or data, arising from your use of, or inability to use, our Service.

c. Third-Party Content and Services

Our Service may contain content, links, or advertisements provided by third parties. We do not control and are not responsible for the practices, content, or privacy policies of these third parties. If you decide to leave the Platform and access the Third Party Sites or to use or install any Third Party Applications, Software or Content, you do so at your own risk and you should be aware that our terms and policies no longer govern. You should review the applicable terms and policies, including privacy and data gathering practices, of any site to which you navigate from the Site or relating to any applications you use or install from the site.

13. Termination

We reserve the right to suspend or terminate your access to our Services at any time, with or without notice, for any reason, including without limitation if you breach these Terms or engage in any harmful activity. Upon termination, all licenses and rights granted to you under these Terms will immediately cease.

14. Governing Law and Dispute Resolution

a. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which Best SAT Score operates, without regard to its conflict of law principles.

b. Dispute Resolution

Any disputes arising out of or relating to these Terms or your use of the Service shall be resolved in the following manner:

• Good Faith Negotiation: First, the parties shall attempt to resolve the dispute through informal negotiations.
• Binding Arbitration: If the dispute is not resolved informally, it shall be submitted to binding arbitration under the rules of the American Arbitration Association. Any arbitration judgment may be entered in any court of competent jurisdiction.

c. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15. Changes to These Terms

We reserve the right to modify or update these Terms at any time. Any changes will be effective immediately upon posting to our Service. Your continued use of our Service constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically for any changes.

17. SAT Score Guarantee Program

Best SAT Score offers an optional SAT Score Guarantee Program (hereinafter referred to as "the Program") whereby we commit that eligible participants will improve their SAT score by 200 points from their baseline score or achieve a score of at least 1500, whichever is lower. Participants who do not achieve the guaranteed improvement may be eligible for a full refund of their 10 Full Length DSAT package purchase, subject to all terms and conditions described herein.

a. Eligibility Requirements

To be eligible for participation in the Program, you must:

• Have taken at least one official SAT examination prior to enrollment in the Program, with documented score evidence.
• Have a baseline SAT score not exceeding 1500 points.
• Submit written confirmation of Program participation via email to [email protected], including verifiable documentation of your most recent official SAT score.
• Purchase the complete 10 Full Length Digital SAT (DSAT) package.
• Fully and diligently complete all 10 Full Length DSAT practice tests available on our platform within the designated timeframe.
• Take an official College Board SAT examination within 90 days after completing all required practice tests.

For participants under 18 years of age, participation in the Program requires explicit consent from a parent or legal guardian. By enrolling a minor in the Program, the parent or legal guardian agrees to these Terms on behalf of the minor and accepts full responsibility for the minor's compliance with all Program requirements. All communications, including submission of score reports and refund requests, may be conducted by either the participant or their parent/guardian.

b. Refund Eligibility

In the event that you do not achieve the guaranteed score improvement (an increase of 200 points from your baseline score or a score of at least 1500 points, whichever is lower) after fulfilling all Program requirements, you may be eligible for a full refund of your 10 Full Length DSAT package purchase, subject to the following conditions:

• You must have satisfied all eligibility requirements listed in Section 16(a) without exception.
• You must submit your refund request in writing via email to [email protected] within 30 days of receiving your official SAT score report. For participants under 18 years of age, this request may be submitted by the participant's parent or legal guardian.
• Your refund request must include: (i) your full name and account information, (ii) proof of purchase of the 10 Full Length DSAT package, (iii) copies of both your baseline and post-Program official SAT score reports.
• The refund, if applicable, applies only to the cost of the 10 Full Length DSAT package and does not include any other purchases, fees, or expenses.

c. Limitations and Exclusions

The Program is subject to the following limitations:

• The guarantee applies solely to the total SAT score (combined Evidence-Based Reading and Writing + Math scores) and not to individual section scores.
• Best SAT Score reserves the right to verify all documentation and information submitted and may deny refund requests that contain inaccurate, incomplete, or fraudulent information.
• Participation in the Program does not guarantee admission to any educational institution or qualification for any scholarship.
• The Program terms are subject to change, and Best SAT Score reserves the right to discontinue the Program at any time, provided that such changes will not affect participants who enrolled prior to the modification or discontinuation.
